2. Acceptance of Terms

By using Lorathis services, visiting our website, or entering into a lease agreement facilitated by us, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, you should not use our services.

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use our services.

3. Service Description

Lorathis provides residential property leasing services in Kuala Lumpur, Malaysia. Our services include:

• Property sourcing and matching based on tenant requirements
• Coordination of property viewings and inspections
• Lease agreement preparation and documentation
• Deposit and payment processing
• Ongoing tenant support and maintenance coordination

We act as an intermediary between tenants and property owners. The lease agreement is established between the tenant and the property owner, with Lorathis facilitating the process.

4. User Responsibilities

4.1 Accurate Information

You agree to provide accurate, complete, and current information when inquiring about properties or entering into lease agreements. Providing false or misleading information may result in termination of service.

4.2 Property Viewing Conduct

During property viewings, you agree to treat properties with respect, follow building rules, and arrive at scheduled times. Failure to attend scheduled viewings without prior notice may affect future service availability.

4.3 Lease Obligations

Once you enter into a lease agreement, you are responsible for fulfilling all terms of that agreement, including timely rental payments, property maintenance, and adherence to building regulations.

4.4 Communication

You agree to maintain open communication with Lorathis regarding any issues, concerns, or changes affecting your tenancy.

5. Payment Terms

5.1 Rental Payments

Monthly rental payments are due on the date specified in your lease agreement. Late payments may incur penalties as outlined in the lease agreement between you and the property owner.

5.2 Security Deposit

Security deposits are typically equivalent to two months' rent and are held according to Malaysian tenancy regulations. Deposits are refundable at lease end, subject to property condition and any outstanding obligations.

5.3 Service Fees

Our service fees are clearly outlined before you commit to a lease agreement. All fees are disclosed in Malaysian Ringgit (RM). Fees are non-refundable once services have been rendered.

5.4 Additional Costs

Utilities, building maintenance fees, parking charges, and other costs not included in the base rental rate are the responsibility of the tenant unless otherwise specified in the lease agreement.

6. Property Information

We strive to provide accurate and up-to-date property information, including photos, descriptions, amenity details, and pricing. However:

• Property availability can change without notice
• Photos and descriptions are representations and may not capture every detail
• Building amenities and services are subject to change by property management
• We recommend viewing properties in person before committing to a lease

While we verify property information, we are not responsible for changes made by property owners or building management after listing.

7. Lease Agreements

7.1 Agreement Formation

Lease agreements are established between you and the property owner. Lorathis facilitates the preparation and signing of these agreements but is not a party to the lease.

7.2 Lease Terms

Lease duration, rental amount, renewal options, and other terms are specified in your lease agreement. You are responsible for understanding and complying with all lease terms.

7.3 Early Termination

Early lease termination is subject to the terms outlined in your lease agreement. Penalties for early termination vary and are specified in each agreement.

8. Maintenance and Repairs

We coordinate maintenance requests between tenants and building management or property owners. However:

• We are not responsible for the actual repair work or its quality
• Response times depend on building management and the nature of the issue
• Emergency repairs are prioritized, but timelines may vary
• Damage caused by tenant negligence may be charged to the tenant

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and property listings, is the property of Lorathis or our content providers and is protected by Malaysian and international copyright laws.

You may view and use our website content for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from our content without written permission.

10. Disclaimers

10.1 Service Provision

Our services are provided "as is" and "as available." While we strive for accuracy and quality, we do not warrant that our services will be uninterrupted, error-free, or meet specific expectations.

10.2 Property Conditions

We facilitate property viewings and encourage thorough inspections. We are not responsible for property conditions, building management performance, or issues that arise during tenancy.

10.3 Investment Advice

Information provided about properties, neighborhoods, or market conditions is for informational purposes only and does not constitute financial or investment advice.

11. Limitation of Liability

To the fullest extent permitted by Malaysian law, Lorathis shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Property damage or personal injury occurring in leased properties
• Disputes between tenants and property owners or building management
• Actions or omissions of property owners, building management, or third parties

Our total liability for any claim shall not exceed the amount of service fees paid by you in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Lorathis, its employees, and representatives from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms and Conditions
• Your violation of any lease agreement or property rules
• Your use of our services or any property accessed through our services
• Any false or misleading information you provide

13. Termination

We reserve the right to terminate or suspend our services to you at any time if you violate these Terms and Conditions or engage in behavior that we deem harmful to our business or other clients.

Upon termination, your right to use our services ceases immediately. Obligations and liabilities incurred prior to termination remain in effect.

14. Dispute Resolution

14.1 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kuala Lumpur, Malaysia.
